By initiating a commission inquiry, submitting payment, or engaging in any transactional correspondence with yenphemous (hereinafter "the Artist"), the client unconditionally acknowledges, accepts, and is legally bound by all terms outlined within this document. Ignorance of these terms does not constitute exemption from their enforcement.
A commission is not considered active until the Artist has explicitly confirmed acceptance in writing and the initial deposit has been received and verified. Inquiry alone does not reserve a slot. The Artist reserves the right to decline any commission request without obligation to provide justification.
A minimum deposit of fifty percent (50%) of the agreed total is required prior to commencement of work. The remaining balance must be settled in full before any deliverables are transferred. Full upfront payment results in prioritized production scheduling.
Accepted methods: USD, Cryptocurrency, Robux (via Gamepass, Shirt listing, or Group Payout). Group Payout must be arranged and disclosed prior to commission initiation. All applicable taxes, transaction fees, and conversion costs are the sole responsibility of the client.
All listed prices represent minimum baseline rates. Final pricing is subject to adjustment based on complexity, technical requirements, revision scope, and turnaround demands. Price adjustments mid-production may occur if the client introduces scope alterations beyond the original brief — these will be quoted separately and must be paid before implementation.
A reasonable number of minor revisions are permitted within the agreed scope. Revisions that constitute fundamental design changes, directional shifts, or additions beyond the original brief are classified as scope expansions and will be billed accordingly. The Artist determines what constitutes a minor revision at their sole discretion.
Upon receipt of full payment, the client is granted a non-exclusive, non-transferable license to use the final deliverable for personal or commercial purposes within the agreed context. Deliverables include: .blend .fbx .obj .rbxm
Source files including ZBrush .ztl and Substance Painter .spp are explicitly excluded and will not be provided under any circumstances. The Artist retains the right to display all completed works in their portfolio and promotional materials unless a formal confidentiality agreement is established in writing prior to commission initiation.
The client may not resell, redistribute, sublicense, or claim authorship of any deliverable produced by the Artist. Ownership of the original creative work, design language, and artistic methodology remains with the Artist at all times. The client purchases usage rights and the final asset — not the intellectual property itself.
If the client initiates cancellation after work has commenced, the deposit is non-refundable. If cancellation occurs after significant production milestones, additional compensation proportional to work completed may be required. The Artist may cancel at their discretion and will issue a full refund in such cases.
Refunds are not issued for completed work, delivered assets, or dissatisfaction arising from failure to provide adequate reference material.
Any unauthorized chargeback, payment dispute, or fraudulent claim will be considered a material breach of this agreement. The Artist reserves the right to pursue recovery of funds, revoke usage rights, and publicly disclose the nature of the dispute to relevant community platforms. All chargebacks will be contested with full documentation.
The client is expected to engage professionally and efficiently. The Artist operates on a time-sensitive production schedule and requires clients to arrive with finalized references, a clear brief, and confirmed payment readiness. Excessive delays may result in slot forfeiture without refund of deposit. The Artist reserves the right to terminate correspondence if the client engages in harassment, unreasonable demands, or bad faith negotiation.
Estimated timelines are provided in good faith and are not legally binding guarantees. Production may be affected by complexity, revision requests, or circumstances beyond the Artist's control. Rush orders may be accommodated at an additional fee subject to availability.
In the event of a dispute, both parties agree to first attempt resolution through direct written communication. If resolution cannot be reached, the matter shall be governed by the laws applicable to the Artist's jurisdiction. The Artist's documented correspondence, payment records, and production logs shall serve as primary evidence.
The Artist reserves the right to amend these terms at any time. Continued engagement following amendment constitutes acceptance of updated terms. It is the responsibility of the client to review current terms prior to initiating a commission.
The client is solely responsible for ensuring that any provided references, logos, branding, text, or requested content comply with the rules, policies, and intellectual property requirements of any platform on which the asset will be used. The Artist is not liable for moderation actions, account penalties, content removals, copyright claims, or platform enforcement resulting from the client's use, upload, distribution, or publication of the delivered files.
If platform upload is requested, the Artist reserves the right to refuse uploading any asset that may violate Roblox Terms of Use, Community Standards, intellectual property policies, or moderation guidelines. In such cases, the client will receive the source deliverables specified in the agreement, and the commission will be considered fulfilled.
By proceeding using the enter button with a commission, you confirm that you have read, understood, and agreed to all terms outlined above.
